It is the exposure of a person to humiliating and embarrassing situations, on a repetitive and prolonged basis. It is done INTENTIONALLY, REGULARLY and against SOMEONE or a GROUP of people.
Harassment is any action or approach that causes embarrassment or intimidation. It can occur through persecution, statements, insistence, among other forms of harassment.
Moral harassment consists of violating the psychological or physical integrity or dignity of another person through abusive conduct. It manifests itself through gestures, words (verbal or written), behaviors or attitudes that expose the employee, individually or in a group, to humiliating and embarrassing situations, degrading the work climate and often affecting the emotional and physical stability of the victim.
Moral harrassment in the workplace exposes people to situations of humiliation, embarrassment, intimidation, aggressiveness, belittlement, causing them psychological or physical suffering, interfering both in their personal and professional lives. Moral harrassment can take place between colleagues, at the same hierarchical level, and/or between bosses and subordinates. It can be direct, in the form of gestures or insults, for example; or indirect, with social isolation or spreading of rumors.
Harassment does not always happen in person. Virtual or cyberbullying, which uses social networks and other digital means to ridicule, discriminate or slander a person or company, presenting the risk that false information reaches many people due to the characteristic of the electronic medium; and the stalker, which is a type of obsession that can be virtual or in person and consists of invading the victim's privacy, threatening their physical and emotional integrity. All of them are already recognized as crimes by Brazilian law.
Sexual harassment is a crime and cannot be tolerated. It is defined by law as the act of making someone uncomfortable, with the purpose of obtaining sexual advantages or favors, when the perpetator takes advantage of his/her status as a hierarchical superior or greater tenure on the job. (Criminal Code, art. 216-A).
Sexual harassment is an intimate and sexual behavior or attitude that is considered unpleasant, offensive and impertinent by the victim.
Make sexual innuendos or proposals, utter offensive phrases, make unwanted physical contact, display pornographic material and disrespectful invitations; there are some examples.
Sexual harassment is a crime provided for in the Brazilian Penal Code and means any practice of a sexual nature in the presence of someone, carried out without the consent of the victim. It can involve sexual overtures, making an aggressive pass, forced kisses, touching without permission, etc.
Jokes or flirting that make a person uncomfortable are considered harassment. Unlike plain flirting, which takes place with the consent of both parties, harassment causes embarrassment to the victim. Non-sexual compliments and mutual flirting are not harassment.
Moral and sexual harassment and all forms of discrimination constitute a violation of human rights and are a threat to equal work opportunities. It is important to understand that conflicts are part of human and work relationships; therefore, not every situation of friction or disagreement constitutes moral harassment. In addition, some acts are inherent to the work and, when they are occasional or moderate, they do not constitute moral harassment.
There can be sexual harassment by men against women, women against men, men against men and women against women.
