PIM-AFE, Novel, Loss of Profits, PID and Family Farmers and Professional Fishermen systems have deadline for closure by December, 2026

One of the purposes of the Agreement for the Remediation of the Doce River Watershed (“Agreement”) is the definitive remediation of people affected by the collapse of the Fundão dam, with transitional and termination rules having been established for the ongoing cash compensation programs. Moreover, the PID – Definitive Indemnity Program was created as a final remediation measure, which will be implemented and executed by Samarco. An initiative aimed at professional fishermen and family farmers was also created.

IMPORTANT: In this time of transition, it is essential that everyone pays attention to information coming from reliable sources. Inconsistent or even false information may emerge, which does not match the guidelines established by the Doce River Watershed Agreement. People whose applications are denied due to fraud detected by Renova Foundation (in liquidation) or Samarco will not be entitled to the cash compensation provided for in the agreement, including the PID. Fraud is any deceptive and bad faith action done to harm someone or obtain personal advantage or cause harm to third parties.

To ensure that your questions are clarified and that you receive correct guidance, only use Samarco’s official channels.

The system will compensate those who were engaged in formal professional activity and can prove the damages

The PIM-AFE System is intended exclusively for people who were formally employed at the time of the collapse and who have the documentation to prove their damages as indicated in the Agreement.

People with pending applications in the PIM or AFE must access the new PIM-AFE System so that their application can be reviewed and they can receive a response.

People who have not completed their registration may complete their information and statement of damages when they access the PIM-AFE System, if applicable.

The presence of the full name and CPF (Individual Taxpayers’ Register) is essential for the application to be considered for other cash compensation measures. Applications that do not include this information will be automatically closed, and it will not be possible to access the cash compensation measures provided for in the Agreement. If you need to correct or complement any personal data, take the opportunity to enter the PIM-AFE System and make this correction.

The status of applications can be monitored by the User Portal. However, filings on the compensation platforms are carried out exclusively by the public defender or lawyer representing the applicant.

Stay tuned:

• The analysis of applications on the PIM-AFE System online platform will follow the new flow established in the Agreement. (Insert link to the PIM-AFE flow document (appendix 2.3 of the agreement)
• People registered with Renova Foundation (under liquidation) as dependents will be able to access the PIM-AFE System with their own data and without being linked to the original registration holder.
• The PIM-AFE System platform will be available on February 4th, 2025. All responses from the PIM-AFE System are expected to be provided in 2025.
• The PIM-AFE System will be available from February 4th to April 5th for joining the online platform.
• During the PIM-AFE System application period, interested parties will have the opportunity to supplement or insert personal data, represent or review the declared damages, as well as the supporting documentation.
• On April 5th, the possibility of joining the PIM-AFE System will be definitively closed. Applications that contain only personal data without a statement of damage will also be closed.
• Those who have already filed an application for cash compensation in the PIM or AFE by 06-Nov-24, and have a pending application, must enter the online platform if they want to have their request analyzed. If this does not occur, the request will also be definitively closed.
• In order to process and analyze the claim for cash compensation in PIM-AFE, representation by a public defender, whose service is completely free, or a lawyer is mandatory, which must also occur by April 5th, 60 days after the system is made available.
• To access the User Portal (portaldousuario.reparacaobaciariodoce.com) and follow up on the status of the claim, a public defender or lawyer is not necessary, as access can be done by the person itself by creating a login and password.

You should know:

• In order to receive cash compensation and AFE, it will be necessary to sign the Settlement Agreement, as which will be considered withdraw from legal action in Brazil and/or abroad, if applicable;
• In case of denial or withdrawal of the PIM-AFE proceeding, the person will have 90 days from denial or withdrawal to join the PID – Definitive Cash Compensation Program, the last opportunity for compensation that will pay BRL 35,000 per eligible individual and/or legal entity;
• PID will be launched by April 2025. To join, the interested party must complete the eligibility criteria of the Agreement.
• The provisions on the AFE contained on this page do not apply to resettled people, as there are specific rules for this group, as indicated in the link resettlement.
• The AFE amount is increased by 20% per legal dependent of the holder. The following are considered legal dependents: spouse or partner, child, stepchild and sibling, father, mother, grandfather or grandmother, grandchild, great-grandparent, great-grandchild, guardianship and curatorship previously reported in the registration.

The payment of the remaining amount of the total of 125 months of Loss of Profits for those people who already receive the amount annually from active will be made in advance and in a single and definitive installment by May 2025.

It will be necessary to be represented by a public defender, whose service is completely free, or a lawyer to receive the Loss of Profits in advance.

Beneficiaries have been contacted since December 2024 for guidance on the necessary procedures. Upon first contact, the victim is informed that he/she will need to be represented by a public defender or lawyer. In 10 days, Samarco will call again to continue with the service if the person already has a legal representative or to arrange a new deadline. The 10-day period is not for definition of application to the system, only for returning service.

Payment of the remaining amount of the total 125 months of active (number of months between the date of the dam collapse and March 2026, deducting the months already received) will be made in advance and in a single and definitive installment, by May 2025.

People who submit an application in the PIM-AFE System and are eligible will receive a proposal for payment of Loss of Profit equivalent to 125 months.

ATTENTION: For people residing in the municipalities of Aracruz, Conceição da Barra, Fundão, São Mateus and Serra (area covered by the technical document, according to the Agreement) who had their Loss of Profits canceled by Renova Foundation (in liquidation), payment will be resumed corresponding to the complementary amount equivalent to 125 months (number of months between the date of the dam collapse and March 2026, deducting the months already received).

It is not possible to open new applications. Only applications that were pending in the system will be analyzed and finalized. Lawyers need to be aware of the new deadlines for submitting documents.

The status of applications may be monitored through the User Portal (portaldousuario.reparacaobaciariodoce.com). However, transactions are carried out exclusively by legal representatives on the appropriate platforms.

Stay tuned:

• As of February 4th, 2025, applications will follow a new flow. (Evaluate creating a link to access the document in Appendix 2.5)
• The public defender, or lawyer must be aware of the new deadlines informed on the platform for submitting pending. Failure to submit the necessary supporting documents within the deadlines set out in the new flow will result in the application being definitively closed.
• Failure to comply with the deadlines set forth in the Agreement will lead to the definitive closure of the application.
• The deadline for submitting the documentation will be 30 days. In case of inconsistencies, an additional 30 days will be granted for submitting the documentation. After this deadline, if the complete documentation has not been submitted, the process will be closed.

You should know:

• Applications that are pending analysis in the appeals tab must be responded to by the administrative expert in charge by May 5th, 2025.
• Access to the appeals tab may occur only once.
• >If the administrative expert in charge of the applications for review of the denial decisions decides to reprocess, this may only occur once, and after a response, it will not be possible to access the appeals tab.
• In case of denial of its application in Novel, the person will have the opportunity to join the PID – Definitive Cash Compensation Program, the last opportunity for cash compensation that will pay BRL 35 thousand per eligible individual and/or legal entity. Entry must occur within 90 days from the negative response or formalization of withdrawal in Novel.
• Individuals may cancel their application in Novel or in the PIM-AFE System to join the PID within ninety (90) days from the date of withdrawal.

The PID – Definitive Cash Compensation Program – will have a simplified damage proof system. Once the eligibility criteria are met, all you need to do is submit an identification document and proof of residence and/or domicile issued on any date. This is the last opportunity for all people who were not included in the remediation process and meet the eligibility criteria.

The platform will be launched by April 2025, and from the opening date, eligible interested parties will have 90 days to join the system. The system will be available for individuals or legal entities classified as one-person company, micro and smaill companies.

The status of applications may be monitored through the User Portal. However, the filings on the platform are carried out exclusively by the public defender or lawyer representing the applicant.

• The PID online platform will be launched by April 2025, and from the opening date, eligible interested parties will have 90 days to join the system.
• After the platform is made available, the person will have a non-extendable period of 90 days to join the PID and present the necessary documentation.
• To join the PID, representation by a public defender, whose service is completely free, or a lawyer is mandatory.

You should know:

• After the application has been processed in the PID, the eligible applicant will receive a proposal for cash compensation of BRL 35,000 per person, in a single installment.
• If accepted, payment will be made upon signing a Settlement Agreement within 10 days of the court approval of the respective individual agreement.
• People who opt for the new compensation gateway may withdraw from the PIM-AFE or Novel to join the PID within ninety (90) days of withdrawal.
• Those who wait for the completion of the application in the cash compensation gateways (PIM-AFE and Novel) and receive a denial may still join the PID within 90 days, from the date of denial or withdrawal.
• For those who have ongoing legal action in the Brazilian and/or international courts initiated up to 26-Oct-2021: acceptance of the cash compensation and signing the Settlement Agreement in the PID will imply waiver of the respective legal action.

The platform will be launched by April 2025.

You should know: This cash compensation is not cumulative with payment in PIM, AFE, Novel or PID, so the same person cannot receive it simultaneously in more than one cash compensation initiative.

Samarco will present, by March 2025, the cash compensation proposal in the fixed amount of BRL 13,018.00 for the plaintiffs of individual lawsuits that address cash compensation for moral and material damages caused by the suspension or interruption of the public water supply due to the collapse and other issues addressed in the Incident of Resolution of Repetitive Demands – IRDR of the Court of Appeals of Minas Gerais.

• By March 2025, Samarco will submit a fixed proposal in the amount of BRL 13,018.00 for each plaintiff in the legal action for water damage. This amount will not be subject to interest on arrears and/or adjustment for inflation, regardless of the time of proposal, acceptance and payment of the individual agreement.
• If the offer is accepted, the person will sign the Settlement Agreement and the amount will be paid by means of a court deposit within 30 calendar days, counting from the court approval of the individual agreement.
• After signing the settlement, the attorneys’ fees, in the amount of BRL 650.90, will be paid by Samarco without deduction from the cash compensation amount. If you made additional negotiations with your lawyer, any contractual fees will be paid by you, without any liability on the part of Samarco.

You should know:

• In the event of refusal of the amount, the court action will continue.

ATTENTION: Acceptance of the water damage proposal does not affect access to the PID, as long as the person meets the eligibility criteria.

The possibility of requesting registration ended on December 31, 2021 and this was maintained in the Agreement. Interviews or portfolio reviews will not be performed. If your registration has not been completed, do not worry, as this will not prevent access to the cash compensation measures provided for in the Agreement. People who have not completed their registration will be able to complete their information and damage statements when joining the the PIM-AFE System.

However, it is important to remember that the presence of your full name and CPF (Individual Taxpayers’ Register) is essential for the request to be considered for the purposes of cash compensation measures. Applications that do not include this information will be automatically closed, making it impossible to access the cash compensation measures provided for in the Agreement.

• Adherence to the cash compensation initiatives provided for in the Agreement are voluntary and optional. This means that access is not mandatory. All interested parties, as long as they meet the criteria for each of the modalities, must necessarily access the online systems for their applications to be analyzed, even if they have previously made a statement to the Renova Foundation (under liquidation).
• In the event of the death, the executor may enter the PIM-AFE System on behalf of the estate, by indicating the personal data of the deceased person, a copy of the judicial or extrajudicial inventory and the respective inventory term.
• The attorney may be replaced by simply submitting a new power of attorney, according to the model contained in the Agreement. However, this will not lead to any extension or postponement of the claimant’s liability periods provided for in the Agreement.
• All individual agreements made due to the cash compensation measures provided for in Annex 2 of the Agreement will be submitted for court approval and payment will be made within ten (10) days after the respective approval, with the exception of cases involving Water Damage, in which payments will be made within thirty (30) days after the respective approval.
• All responses from the PIM-AFE System will be given in 2025. In the PID, payments will begin in 2025. All services will be concluded by 2026.

Important: Cases in which document fraud is detected by the Renova Foundation (under liquidation) or Samarco will result in the inability to access the compensation measures provided for in the Agreement, including the PID.

It is mandatory to be represented by a public defender, who provides assistance completely free of charge, or a lawyer.

Check the amounts that will be paid by Samarco without deduction in the cash compensation.

Attorney’s Fees

• The attorney’s fees provided for in the Agreement, will be paid directly by Samarco, within the limits provided for, and within five (05) days after the receipt of the cash compensation amount by the eligible person. In cases involving water damage, payment will be made within 30 days of the approval of the individual agreements. The amount of these fees will not be deducted from the cash compensation paid to the individual.
• The Agreement establishes the amounts of attorney fees for the cash compensation measures, which will be paid directly by Samarco according to each system: PID: 5%; Family farmers and professional fishermen: 5%; PIM-AFE System: 5%, limited to BRL 10,000; Water Damage: BRL 650.90; Novel: 10%; Active Loss of Profits: 5%, limited to BRL 10,000. Active AFEs: 5%, limited to BRL 10,000.
• If you enter into additional negotiations with your lawyer, any contractual fees will be paid by you, without any liability on the part of Samarco.
• The applicant may seek the Public Defender’s Office to file their application, and in this case, the service is completely free of charge.

The Agreement provides that individuals interested in joining any cash compensation system may track the of their request on the User Portal. The User Portal is not an access channel to the cash compensation systems provided for in the Agreement.

The filings on the platforms of the cash compensation systems provided for in the Agreement, such as filling in data, sending documents and accepting the proposal will be carried out exclusively, by a public defender, whose work is free of charge or lawyer.
